FixRoster Terms of Use

These Terms of Use govern your use of the FixRoster mobile application, provided by Sleepycat Software LLC("Sleepycat Software," "we," "us," or "our").

By downloading or using FixRoster, you agree to these Terms.

1. Using FixRoster

FixRoster gives you a limited, personal, non-exclusive, non-transferable license to use the application on devices you own or control, subject to these Terms and the rules of the app store through which you obtained it.

You may not copy, resell, redistribute, reverse engineer, interfere with, or misuse FixRoster except where applicable law expressly permits it.

2. Free tier and FixRoster Pro

The free version includes unlimited local searches, one property, one active job, up to five candidates per job, up to three quotes per job, basic quote comparison, notes and contact history, one hired provider, five payment records, and one completed job retained. The free version includes no advertising and no watermark.

FixRoster Pro is an optional one-time purchase that unlocks unlimited properties, jobs, saved providers, candidates, and quotes; multiple hired providers per job; detailed quote line items; payment schedules; change orders; receipt and document attachments; reminders; full provider history; PDF and CSV exports; portable backup and restore; and future core tracking features. It is not a subscription.

3. Purchases and refunds

Purchases are processed by Apple App Store or Google Play, not directly by Sleepycat Software.

Purchase restoration requires the same applicable store account used for the original purchase. Apple purchases do not transfer to Google accounts, and Google purchases do not transfer to Apple accounts.

Refund requests and payment disputes are handled according to the policies of the store that processed the purchase.

4. Your data

FixRoster stores properties, jobs, providers, quotes, payments, attachments, reminders, and history locally on your device. You are responsible for safeguarding your device and for maintaining any backups available through your operating system or FixRoster's backup export.

Deleting FixRoster, deleting records, losing the device, or experiencing device or storage failure may result in permanent loss of data. FixRoster does not currently provide cloud synchronization or independent cloud backups.

5. Your content

You retain ownership of the property, job, provider, quote, payment, attachment, note, and history records you create using FixRoster.

You are responsible for ensuring that your content and your use of FixRoster comply with applicable laws and do not infringe the rights of others.

6. Provider information and accuracy

FixRoster does not verify contractors, diagnose repairs, recommend an objectively best contractor, guarantee quote accuracy, or process payments. Provider details from maps and search services may be incomplete, outdated, or incorrect.

You remain responsible for confirming provider qualifications, licenses, insurance, availability, and terms directly before hiring or relying on any quote, estimate, or record in FixRoster.

7. Ownership

FixRoster, including its software, design, branding, and other materials, is owned by Sleepycat Software or its licensors. These Terms do not transfer ownership of FixRoster or grant rights beyond the limited right to use it.

8. Availability and changes

We may update, modify, suspend, or discontinue parts of FixRoster. We do not guarantee that every feature will always be available on every device or operating-system version.

We may also update these Terms. The effective date above will be revised when updated Terms are published.

9. Disclaimer

FixRoster is provided "as is" and "as available." To the maximum extent permitted by law, Sleepycat Software disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

FixRoster is a planning and record-keeping tool. You remain responsible for reviewing provider information, quotes, contracts, payments, and exported documents before relying on or distributing them.

10. Limitation of liability

To the maximum extent permitted by law, Sleepycat Software will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost data, lost profits, property damage, or repair or production problems arising from your use of FixRoster.

Our total liability relating to FixRoster will not exceed the greater of the amount you paid for FixRoster or ten U.S. dollars.

Some jurisdictions do not allow certain warranty exclusions or liability limitations, so portions of these sections may not apply to you.

11. App Store Terms

Your use of FixRoster is also subject to the applicable terms of Apple App Store or Google Play. If these Terms conflict with mandatory app-store terms, the applicable app-store terms control.

For applications obtained through Apple App Store, Apple is not responsible for providing maintenance or support for FixRoster, and Apple is a third-party beneficiary of the applicable license terms.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, except where the laws of your jurisdiction require otherwise.
